This research paper addresses the issue of digital personal data of the e-consumer under Algerian legislation, considering such data as one of the most important elements related to the protection of consumer privacy in the digital environment. The study aims to clarify the concept of personal data and identify its main forms, particularly data relating to identity, address, banking information, biometric data, and other information that may enable the direct or indirect identification of the consumer.
The study also examines the position of the Algerian legislator regarding the protection of such data, particularly in light of Law No. 18-07 on the Protection of Natural Persons in the Processing of Personal Data, while drawing on certain comparative legal frameworks. The paper further explores the electronic signature as one of the most important forms of digital data and means associated with electronic transactions, as well as the legal issues it raises concerning the verification of the consumer’s identity and the protection of their privacy.
Furthermore, the study highlights the main risks threatening personal data, particularly cyberattacks, unauthorized access to files, and the exploitation of data without consent. This underscores the need to establish effective legal safeguards to protect e-consumers and their personal data in light of the continuous development of digital transactions.
