Technological transformation has witnessed a significant expansion extending into the criminal field regarding penal procedures, despite the specificity of this domain, its close linkage with fundamental rights and individual freedoms, and its deep roots in criminal justice systems in terms of their agencies, operations, and procedures. In response to several considerations, including the proper administration of justice, geographical distances, the movement of persons, the preservation of public security or health, and the respect for reasonable timeframes, the legislature adopted remote video communication technology—particularly during the investigation and trial stages—as a necessity for modernizing criminal justice. This poses a challenge in balancing the effectiveness of this technology with the requirements of modern criminal justice that respect the guarantees granted by law to the accused during investigation or trial.
